supervisor campos: for months. so are you aware that if the 18- month time span when to and the fact that the following procedures would not be covered. mri's will not be covered because they're too expensive. chest pain, the average cost of that, $15,000, would not be covered because it is too expensive. we talked about the cost of normal delivery, $16,000. if you have ac section, $22,000, again, would not be covered. any treatment of pneumonia, $23,000 would not be covered by what the mayors is saying. an appendectomy without the complications, if with complications from a more expensive, 35 of the dollars, would not be covered. kidney stones, any kind of urinary tract infection, $40,000. again, $6,000 would not be covered. so is the mayor aware that all these procedures that are procedures that people throughout san francisco need would not be covered by what you're proposing? >> the policy goal of the mayor in the proposal i just laid out is to not look at those absurdly high costs, and we cannot as a city solv

supervisor campos's legislation does that. it does so perfectly and it's not with a steel hammer or however it was previously described. it does so in a way that will ensure workers have access to their h.r.a.'s and it does so in a fashion to help make health care more accessible throughout this city. there's really only one conceivable reason i could personally imagine why people would be in opposition to this, and it's because probably coming from that 13% of business owners or employers who feel that they are somehow entitled to pocket this money that is set aside specifically and from the initiation of this legislation which was set to initially pay for health care. that's just not right. it's a disgrace to see people supporting that mentality here. and we hope that's not the case. and we also hope that we do not spend any more taxpayer money on unnecessary research. this is a problem that's been well established, well documented and it's time to act now to fix it. thank you. >> thank you. let me just read a few more names

supervisor campos: thank you, mr. palsen. next speaker, please. >> good afternoon. my name is charlotte noss. i'm a staff attorney at the legal aid society employment law center. i'm here to speak in favor of supervisor campos's amendment. this is the largest legal organization in the western united states. we're dedicated to protecting rights of low wage and immigrant workers. we hold five weekly worker rights clinics, provide legal advice and referrals to over 2,3500 workers a year. in addition we have several telephone hot lines. for example, work and family hotline already so far in 2011 we have received over 1,000 calls. we see widespread abuse in low wage and immigrant-dominated industries, like rampant wage theft in industries we serve, the current loophole allows employers to steal employee benefits. we have heard stories from workers who are impacted by the loophole. workers who don't know they have these benefits and incentive for employees to hide these benefits from the employees. we heard f

supervisor campos: thank you again. next. >> also with the chinese progress of association and the progress of workers alliance. my organization, we work directly with hundreds of low- wage immigrant workers who suffer from low wages, poor working conditions, and therefore higher exposure for health risks. when we talk to our members about their needs, time and time again, it is jobs and health care at the top two issues that they face. we have seen examples in our community of workers who submitted it reimbursements for healthy san francisco -- for hra's and were refused without explanation. then there were worker's buying health care and switched over to hra because they could presumably get the money back at the end of the year, but they continue to be reduced reimbursements. there was bribery saying they would get kickbacks at the end of every month that you do not use hra's. when workers are low wage, speaking about this issue, you know, coming forward with what is happening is extremely frightening, and they are v

supervisor campos: thank you. speaker. >> good afternoon. i'm director of the office of small business. i am here this afternoon, want to thank supervisor campos for continuing to identify the need that we need to close the loophole. just wanted to note, the commission has not heard of the new piece of legislation and will be doing so on monday, along with supervisor chiu. the new draft still has some of the issues of concern for the commission, which is the potential millions of dollars out of the economy, and the immediate job loss. i will not reiterate much of what is said in a relationship to what has already been stated. a couple of things need to be taken a look at better economic analysis report did not address. types of jobs in the income of the jobs that will be lost with this. with the current health care security ordinance, there are many businesses i have spoken to that have sort of stunted their growth and chosen not to grow past 19 jobs because they cannot afford the bump up into the 20 or over emplo

supervisor campos: supervisor farrell. supervisor farrell: to be honest, i have no opinion you can take it on face value, but it does weaken the cool, so i am fine with it the way it is. ansupervisor campos: from my perspective i agree with the findings. i think there are maybe differences in opinion as to what some of the reasons maybe, and i think staffing may be one of those issues, but i do have a very real concern about what is happening with respect to the issue and find a number two in the enforcement of sunshine or dance task force actions, and i think that needs further discussion, and i think the recommendation as stated makes sense, which is that all enforcement actions deserve a timely hearing by the ethics commission. i do not think that it's a radical concept. with respect to finding member four, i again, i think that there is an issue there about the appearance of impropriety. i agree with president chiu, i am not sure the specific recommendation is necessarily the way to go. it maybe there are some elements

supervisor campos: thank you. next speaker please. >> good afternoon, supervisors. i am here today to reiterate our support. we have supported the central subway since the beginning. reason being back the connectivity it is providing in our transit first city, and it is the same reason why we are supporting it today. we are well aware of the mta strategy as was pointed out in the findings of the grand jury report, but i cannot agree more with what one of the speakers have said -- the challenges should not prevent us from moving forward into the future. my group finds some of the findings -- we can not suspend them. by december 30, we talk about the lack of communication. the experience of my group in the last 10 years was every time we had called for additional answers for any questions, we have always received responses from central subway promptly. our members have been attending meetings religiously, and we just felt that we have gotten so much information. sometimes, we are overwhelmed with information. we are

supervisor campos: thank you. i do believe that we know enough to know that the current situation is not from my perspective the right policy approach, that there are still enough questions that need to be addressed, which is why -- i do not know what that answer is, which is why we are asking the mta to reconsider. quite frankly, i do believe it is important for us to move forward, because even though the hope is that this will change with the new leadership at mta, we have had many examples where the board of supervisors has heard from the mta in the past they're going to move in a certain direction and make progress in a certain area, and unfortunately that has not happened with some issues, so i think it is important for us to do that. i appreciate your perspective in respect to that perspective, but i would ask that we move that item forward with a positive recommendation. could we have a motion by president chiu? we can have a roll call on that. >> supervisor chiu? >supervisor chiu: aye. >> two ayes, one no.

supervisor campos: thank you, mr. president. i guess yet another unanimous court -- vote at the board of supervisors. this item has been before us many times, debated over and over again. i am going to spare the discussion -- i am happy to engage in the discussion, but i believe the facts are clear. we introduced the original legislation in may of this year. this has had a number of hearings, not only at the government audit committee, but at the health commission, the small business commission, and the board. people have tried to complicate this issue, but it is simple. it is about protecting the right of workers to have health care. it is about protecting consumers. i would simply ask for a vote. before i do that, i want to make a clarifying amendment. it is an amendment that clarifies that when we talk about the termination of these accounts -- the closing of these accounts happening 18 months after termination of employment -- clarifying that it is a definitive amount of time, at 18 months past employment, whether or not the
